Last year after the Seattle Seahawks won the Super Bowl, I wrote about the “12th Man” trademark and how the Seahawks did not own the rights to it. From watching tonight’s playoff game against the Carolina Panthers, it is evident the Seahawks organization has added to its trademark portfolio and is including WE ARE 12 when referring to its fans.
In December of 2013, the Seahawks organization filed the following intent to use (“ITU”) trademark application. An ITU application essentially reserves the rights to use a mark when you are ready to begin offering the goods or services “in commerce.” To convert an ITU application to one that is “in-use,” you would have to file a “statement of use” and include a specimen to show the mark in commerce. The Seahawks did just that right before this year’s NFL playoffs.
