Brooklyn Brewery Files To Cancel Sixpoint Craft’s BKLYN Trademark

h

February 4, 2016

Plaintiff: The Brooklyn Brewery Corporation

Trademark Applicant: Mad Scientists Brewing Partners, LLC D/B/A Sixpoint Craft Ales

At Issue: BKLYN

New York’s largest brewer has filed a petition before the Trademark Trial and Appeal Board for the cancellation of Sixpoint Craft Ale’s BKLYN trademark.  A cancellation proceeding is filed when one party is looking to remove another’s mark from the trademark register.  They are typically filed when a party feels like it is being damaged by the registered mark.

Here, Brooklyn Brewery says that Sixpoint’s BKLYN trademark is likely to cause confusion, mistake and deception with its own BROOKLYN, BROOKLYN BREWERY and BROOKLYN-formative marks.  The United States Patent and Trademark Office issued a registration to Sixpoint for BKLYN for beer on the Supplemental Register on June 14, 2011.
